No one This Land

26th July 2011

I have been dealing with Ipswich Borough and Suffolk CC over a pothole incident from Feb 2010. There has been many Land Registary searches conducted and I have been told now that the land is not own by the Borough or the Council and they are therefore not liable. They have not told me whom is accountable for this land only it is not them, they say it is unclear from the land register searches whom actually owns the land.

Suggestions welcome of where to go next.

Tricky one!

I assume its a road? If so, liability might rest with the frontages (i.e. the residents living along the road) who would be liable in proportion to the degree of benefit each of them receives.

If there is one, Parish Councils are often a good source of information and I recall in the far recesses of my mind that there might be some old law buried somewhere which places "no mans land" into the pocession of the local Parish Council.

Best I can come up with I'm afraid, hope it helps.
