What is Reasonable system of inspection and repair??

Hi, I hit a pothole on 23rd May which caused me to require a new wheel and tyre. I followed the correct procedure of contacting council with all relevant details and photo's. Their insurance have now sent me a letter saying detailing the below:

that they have a resonable level of inspection and repair which for the area it occured is 3 months for inspections. They siad they raised a priority 5 repair on the 17/05/11 six days before my accident. They said the target completion date is the 5/08/11. They said as my incident occured betweent he date of the repair order was raised and the date the repairs were completed, they can not see how the council has been negligent.

Is it possible that they are able to get away with this as they knew the pothole existed already? Should they not have put a sign up so I didn't hit it? Any help with this would be much appriciated. I do not see how they can give themselves 3 months to repair a pothole!

3 months is a long time to repair a pothole. I suggest you download a copy of the national code of practice (see our step by step guide) and ask them to explain how they justify the 3 month period when national guidance is 24 hours.
