I hit a large pothole on Sunday evening which shattered my alloy wheel. I returned to the site after work the very next day to take photographs, by which time the pothole had been filled in. Nevertheless I took photos, as the recent repair is visible to see. Furthermore, using google street view, one can see evidence of previous repairs in the exact same area - thus it is clearly a persistent problem area which hasn't been adequately repaired.
I called the council to find out when the pothole had been reported, but was told there was no log of it having been reported. Where does this leave me in terms of being able to claim for the damage it caused? The bill from BMW totals £800!!
The pothole being filled in doesn't change your position at all. It might show that the local authority acted promptly, but at the moment you don't known how strong your claim is. Have a read of our step by step guide.
