Pothole on a Private Unadopted Road

I've just taken my car into the garage as a pothole caused some damage to my car. I've just found out that it has dislodged something in my dear box which has not only caused me having to get a new gear box but also the clutch repaired as the gearbox oil has ruined the clutch. This is going to cost in excess of £1,000.

The problem I have is I have been in contact with the council and because the pot hole is on a private road they are not liable, It was on a road on the way to a car park for two shops (Staples and Majestic Wine). Who can I make a claim to for this? Would these two companies own the up-keep of the road as it’s solely used for their car park?

Am I actually going to be able to make a claim?

I reported this pot hole on this site earlier so hopefully I can make other aware.

Any advice would be much appreciated

You need to do some digging around to find out who owns and maintains the road. It's unlikely to be the shops themselves, but more likely the company they rent the premises from. I would start with the shop managers ... I'd be surprised if they don't know.
