Pothole in area of roadworks

19th September 2011

A few days ago I hit a large pothole damaging my front off-side tyre. The pothole was in an area of major roadworks linked to a new road being built. The pothole was caused by a break down in the road service in what appears to be a poorly laid service strip running across the road. It looks like it's been laid recently and is related to the on-going works. I believe the council still have overall responsibility for the road maintenance. How do I stand with making a claim?

Normally, during roadworks, the contractor assumes responsibility for the road between the agreed extents of the works, but this will depend on the contract that is in place. I suggest you contact the local authority and ask them who you need to deal with.
