Pothole claim declined

After 7 long months, I have received a letter saying my claim was declined. I hit a pothole on a main route into Birmingham. It Damaged both of my tyres on the offsite of the vehicle. I took photos etc.

The claim was rejected for the reason that my incident was on the 10th March 2011 and the pothole was reported on the 15th March and they have enclosed a reference number for this. They claim was they werent aware of the pothole until the 15th. There is no negligence on thier part. Does that seem fair?

That's one side of their argument. They also need to show that they did what they could to identify the pothole before you hit it. If they have not sent you details of safety inspections before your incident, you need to be asking for them.
