Loose Chippings

22nd October 2011

I was driving towards Bradford on the M606, travelling at 70mph.

I came across loose chippings on the road and slowed down immediately. When I got home to check the damage, I noticed a lot of damage had been done to the car.

I obviously cannot stop to gather any sort of evidence as it's a Motorway.

I can take pictures of the damage but it's as far as it goes.

Can you please advise what I should do? How do I go about seeking compensation?

Thanks

Unless the road surface was breaking up, this time of year, the chippings are highly unlikely to have come from any operation undertaken by the highway authority and its much more likely that the chippings fell from a passing vehicle.

The burden of proof is on you .... so, who are you going to claim compensation from? Its not the fault of the highway authority and you will never trace whoever dropped the chippings. You could ask some question under the FOI Act (see our step by step guide) to maybe find out if they knew about the chippings before your incident and take it from there, but I wouldn't rush to make a claim just yet as you have no idea who or what caused the damage.
