Witheld info (s39)

Hi

I submitted a FOI request after a rejected claim.

The reply was that it has been handled under Environmental InformationRegs 2004, not FOIA, and exemption has been claimed by virtue of s39.

The exemption has been used to withhold the details of frequency and findings of road assessment which is obviously what I was after to see if they'd been checking the road as expected prior to my accident.

Any advice, please?

Thats the danger of submitting the request after the claim and why we recommend you do things the other way around. Sadly, few people take any notice of that suggestion.

Now you need to request the information via the claim handler on the basis that you consider it to be 'disclosable'.
