i it a large pothole which burst my tyre and damaged my alloy, i have been told today i will get no compenstaion as the road was inspected 5 days before my incident and that it is the verge that has eroded.... its a small narrow road and you have no option to drive so close. since the council inspected it they have placed 3 cones in the pothole and are still there, any advise as i am really mad that they have dismissed this

The inspection is far from irrelevant and will be used in Court to defend any claim you make. You have to prove some element of negligence on the part of the council. To do this, you gather information about their actions and compare it against National standards and we tell you how to do this in our step by step guide.

This is based on the asumption that the cones were only put there after you complained:
If I were in your position I would argue that the Council placing cones there is acknowledgement of a problem which either occured after the inspection or that the inspection missed. In the first instance the inspection is irelevent and in the second, incompetant. My feeling is that they wouldn't bother with cones if they didn't have to..
Whether it's their responsibility or not I don't know, but keep on at them. Making a nusiance of yourself is a great way to get things moving.
