Who is liable on a construction site?

Hi All,

I've bought a new build property and there is still construction happening all around me. The road that leads to my garage has steep ramp in it, no warning sign, speed restriction, nothing. It's currently used exclusively by construction traffic and my neighbour and myself to access our garages.

When reversing round to my garage in my partners car (the only time I've ever done it), the drop in the road caused the exhaust to hit it and break. I've contacted the builder (countryside properties) who told me to claim on my own insurance. My own insurance say they wont pay out because they can't counter claim against the builders, plus I don't want to claim on my own insurance.

Who's liable and how should I proceed? Any help much appreciated.

The developer is liable, but it is a private claim you will need to make.
