I have had my claim rejected because the Council says it is their policy the inspect the road every 3 months and at the last inspection there was no sign of it. My pothole incident was just 6 days before their next inspection was due and they state therefore they are not liable. The pothole was over 20 ins long x 12 wide and tapered down to 7 ins deep and the road itself has bad verges for long stretches that are pot hole riddled. They repaired the road within 4 days of my complaint. Is it worth me contesting their rejection and, if so, what would the best grounds be?

The 3 areas you can normally consider are as follows:
1. Had anyone complained about the pothole before you hit it.
2. Was the inspection frequency appropriate for the road.
3. Was the method of inspection appropriate.
