Pothole on M25

10th March 2010

On Friday evening I was travelling on the M25 between Junction 16 and 18 roadworks when the car in front hit a pothole and showered my car with stones.

These stones caused 12 major chips and dents to my paintwork - something that's going to cost over £1,000 to repair (I have the quote).

Can I claim against the M25 - if so, who do I write to?

Thanks for the quick reply - greatly appreciated.

Whether the Highways Agency has a 'second-to-none' inspection regime, the potholes on Friday were big enough to hide a Ford Ka!!

I'll keep everyone posted on any outcomes.

You can try to claim if you wish to, and in the first instance you should contact the Highways Agency (www.highways.gov.uk)

Note - inspection regimes on motorways and trunk roads are generally second to none. As a consequence, they usually have a very robust defence and your chance of a successful claim is very slim. Read the bit about Section 58 on the step by step guide on this website.
