Liabality passed...

9th June 2010

after waiting for 5 months the firm has come back with this:
We apologise for not returning to you sooner.

We confirm that he have now received our clients Highways Report. This
documents a regular and effective inspection and maintenance system
operated by our client and therefore we must advise liability is denied
under Section 58 of the Highways Act.

Under the regulations of the CPR we need to provide you with a copy of the
report, which is around 200 pages long. Please therefore advise us of an
address which we may send it to via Royal Mail.

With regards to your claim, at the time of your accident Thames Water were
in control of the location due to a burst mains pipe and as such are liable
for the accident. The disclosure we will be forwarding to you will aid in
recovering compensation from Thames Water.

can you advise me if this is worth while chasing again with thames water? and if this is the correct thing to do.

sorry yeah missed that out.
Driving along a 2 lane rd behind a bus on the inside lane when i suddenly hit the floor and was skidding along the road due to me going into this massive pothole obvoiusly with a motorbike. I luckily suffered no injury but my bike had an repair estimate of around £800 including my helmet.

There is not enough information here for anyone to say if it is worth you claiming against Thames Water. You haven't even said what happened during your incident.
