i recently made a claim to council about damage to my wheel and alloy whilst driving home one day hit huge pot hole.
i took pictures of road and pothole and sent them to council.
received my reply today from Zurich claims department saying council are not been negligent they said they carry out inspections annually and the last inspection was on the 20 august 2009 and the defect that was the cause of the accident was not present.
further more they did not receive no letters or phone calls reporting this defect.
they are lying about no one reported the pothole when i phoned for a claim form the women on phone told someone else has reported this same pothole to and she knew where it was exactly.
it took them 2 weeks after i reported it to them to fill it up.
were the council negligent knowing someone has reported the pothole and they still never fixed it could i use this against them.

i have today recived my foi and it shows on thier thier last inspection was on the 20/08/09 annul walked next to it.
and the hole was 2 inches deep
it shows a picture of pothole 25/05/10 pot hole still not fixed after 15 days.
what is a resonable timframe to fix the pothole.
and is their anymore info i should be looking for .

Unless she has an exceptional memory, perhaps the lady you spoke to had received two reports of the pothole that day, and perhaps they mean that no-one reported it in advance of the 2 incidents? These are issues you might want to establish with them.
If they knew about the pothole some time before you hit it, then this is an avenue you could pursue in your FOI request for information.
