section 58 refusal

After going through all the process of FOI ihave had the section 58 letter saying that on the 10th feb 2010 the road was inpected and there was no defects found but on the 3 march there was a huge pot hole clearly marked in yellow for repair so it must have been seen on inspection and marked for repair, studied the report and found on the 10th of feb 2009 the same pot hole was reorted (1 year earlier ) there was no other inspections recorded between the 10 feb 2010 and the 3rd of march and no other reorts for that section since the previous year ( like its been missed and just got worse over the year) on that section of road where do I satnd with this

You write to whoever is handling your claim and highlight everything you have said here, and what it all suggests to you. You inform them that if you are correct, you believe that you are able to demonstrate negligence on their part and that you wish to offer them the opportunity to respond.
