I sustained damage to my wheel and tyre as a result of hitting a pothole in Northumberland. Northumberland Council passed the claim on to their insurers who have come back to say that I have to prove that the council were negligent before they will consider the claim further. The road was surveyed back in May 2009 and as far as they are concerned that is OK. Has anyone any idea how I can prove they were negligent? I live 160 miles away from where the incident happened so I have no knowledge of the state of the road prior to the incident.
Have a look at our step by step guide for advice on gathering information and considering if they have been negligent.
Part of the information gathering 'exercise' is to assist in considering the type of road, which might prove difficult living so far away. Perhaps you could try google streetview to assess the road?
