I hit a pothole in early March causing £200 damage to my car in the form of a replacement tyre. The council have rejected my claim for compensaition stating they were aware of a defect on 5th February but allow 3 months to fix it, it was then fixed on 25th March (Section 58 of the Highways Act 1980)? and so are not held negligable. Should i pursue the matter as there were no warnings signs placed even after the council had been made aware of the defect to the road?
£200 for one tyre? Wow!
You need to have a read of our step by step guide and have a look at acceptable response times in the national code of good practice. Most authorities repair potholes within 24 hours, so 3 months seems a bit extreme.
