Claim rejected

Hi,

I had a claim rejected by the coucils insurers because the road is inspected once a year and was inspected in October 09. Obviously we had a really cold winter which caused all of the pot holes. Is there a way of proving they were at fault? or should have been inspected again due to the advers weather? or a different way of moving forward?

Any help would be appreciated.

What do you want to prove they are at fault of? You will have trouble suggesting that they should have inspected more because of the bad weather - they had no resources for that because they were dealing with the bad weather.

Have you had a look at our step by step guide and the national code of good practice? You perhaps need to look at inspection methods and frequencies. 1 inspection per year is only recommended for very few types of roads.
