m90 heading north from dunfermline to perth.....

i was heading to perth on the 15 of sept 2010 doing about 60mph when passing juc 8 i hit a pothole on the inside lane with the passenger side wheels of my car, i then got a flat tyre so pulled into the emergancy layby between juc 8 & 9..

i then got out my car to find that my tyre was flat and being a focus st it does not come with a spare wheel so had to get someone to come and rescue me..

i then phoned the council which i was then told they would send me a claim form out on behalf of bear scotland, then took details of the pothole then that was the end of that..

i then waited 30 mins for a friend to take me to a garage to get my tyre repaired leaving my car on the side of the road..

when i got to kwick fit at perth(only one to have my tyre size in) it turned out i needed a new tyre and a new alloy as mine had cracked so told them just to put a new tyre on the cracked alloy as my car is abandond on the m90 at first they refused then said they would do it but they take no resposobility to anything that happens...

so got back to my car fitted the tyre and took my car home as i could not afford a new alloy at the moment..
on my car pulled to the left and pulled even harder when under braking .. i also get vibrations through the steering wheel if i go over 60mph..

so i took it to farmer autocare in edinburgh where they inspected my car and said that they suspect the vibrations are from my cracked alloy and the pulling is the tracking.. they then went on to find a blister in the side wall of the passenger rear wheel which was not there on inspection of my brakes by the same garage 4 days earlier..

anyway took it home where it has sat since as its to dangerous to drive so now im stuck with puplic transport until i can find another £420 for a new tyre, alloy and tracking..

so i filled in the claim form and attached all photos of the damage to my car, i could not get any of the pothole as it was on a motorway and i have not had a car to go back late at night where i might have a chance of taking one..

so sent it last week and just got a reply today saying the admit liability but wont pay out as they have repaired the hole within 7 days!!!!!!!

im currently asking for a report on the road with the freedom of info act with the guidence off this site..

what should i look out for to happen?

You've really been round the houses and I hope you get the result you desire. rnrnYou need to check their scheduled maintenance against what was carried out and see if there was negligence in the maintenance of this road around the time of your accident. If they were looking after it as they set out to do then it is very difficult to fight your corner.
