Should in keep trying?

My wife hit a pothole on 17th January it was heavy rain at night in traffic. This bent an alloy wheel and broke a coil spring. The cost of the repair was £1800.
The pothole was 31 inches long x 17 inches wide x 5 inches deep. The council state that they inspected the road on the 10th December 2010 and check the roads every month on that day. We know that on that day the area we live in there was snow and ice on the ground also the next inspection must be late as my wife hit pothole on 17th Jan which is a week after the next check was due. They say they are protected under section 58, i do have photos of damage and pothole. I also have measurements of pothole.
