Damage to Car - £500

My boss hit a pothole in his Ferrari on the 20th March 2011 causing £500.00 worth of damage.

After the incident he took pictures of the pothole, the damage caused to his car and we immediately informed the council. They then sent out a claim form which we completed and sent back.

The council then sent me an email with a claim number, letting me check the process of the claim online. The online form stated that they were now aware of the problem and the pothole was fixed on the 13th April 2011.

We received a reply in the middle of June stating that the council was not liable. There reason given was that they had inspected the road on the 23rd February 2011 and the pothole was not present.

I have spoken to the Citizens Advice Bureau and they have advised me to either write back to the council or to inform our insurers and see if we can claim it back through them.

I would greatly appreciate any advice as to what we should do next, particularly with regard to writing a letter back to the council.
