any chance of getting my excess from the council

Left front wheel of my car went into a pothole in March. The car was repaired by my insurance company for which I had to pay £350 excess. I have then claimed compensation from the council in the amount of the excess which has been handled by their own insurance company. I just received a letter from the council's insurance company saying that "the road is inspected every 3 months. At the last inspection in February no defects that exceeded intervention levels were recorded at the place." Accordingly they refused my claim. Their 3 monthly inspection frequency seems to be in accordance with the code of practice. Any help to get the excess from the council would be much appreciated.

Some claims you can't win and you have to accept that. If the frequency is OK then the only avenue you might want to look at is the inspection method. Have a look at our step by step guide for advice on the issues.
