hi i hit a pothole in westminster and damaged 2 wheels on my car...

the pothole was deep, in the middle of the road, large, and filled with water at the time so could not be identified!

the council sent me forms to fill out which i did along with pictures of the site, rough sizes of the pothole and a googlemap location.

they filled the hole with tarmac (which i think is a temporary fix) they then went round and round in circles saying as the rule of thumb is its meant to be more than 50mm deep to claim compensation they refused to pay out...

however, they never fixed the hole properly, and it appeared again 6 months later, i left it for 3 weeks to see if they would do anything, i then re reported it... i was told that it would be filled immediately and fixed properly within 25 days... it was not... and 4 months on, i noticed it has been filled for a 3rd time, im not sure if its permanent this time...

the pothole was about 30cm long by 15cm wide.

i could not get exact measurements as it was a busy road...

i feel that westminster are just looking for excuses and i am waiting for a freedom pack from them, which they have messed me around with for 6 months...

the pictures below show it 6 months later after it was filled and starting to reappear.

it doesnt show the depth but definatly the size and width of the pothole nad the fact it was in the middle of the road (with roadworks on the side of the road forcing you to drive over the pothole)

do you think i have a case?

westminster today have come back and refused to give the freedom of information act documents as they say that it can be used to make fraudulent public claims against the council!rnrnalthough it is within reason to ask for it, public interest in avoiding fraudulent payouts ways heavily over the fact that public information is needed.rnrnthis info constitues a refusal notice in accordance with section 17 of the act...rnrnnow what? do they have something to hide?

What happened after your incident is largely irrelevant and I would suggest that you don't want the fact that you did not report the pothole for 3 weeks to become an issue as a Court is likely to conclude that it wasn't very civic minded of you.rnrnYou will not know your chances of success until you have information about inspections and reports before your incident.
