Kent CC non payment

old pothole story (2006) but still relevant... usual preface, hit a pothole on a country lane after a spell of bad weather, contacted Kent CC Highways Dept, completed form, with photos of pothole and damage to tyres/rim.

KCC declined to make payment based on their payment/claim protocol which at the time was....

"if we don’t know about the pothole (not been reported) you cannot make a claim, if we (KCC) do know about the damage we are allowed a 'reasonable amount of time' to make the repair, during that period any damage to your vehicle cannot be claimed for".

This incident went onto Radio Kent (John Warnett morning show), where again the KCC Highways spokesman confirmed this policy - the question is - can you make a claim - who decides what is reasonable?

I would check the Well-maintained HighwaysrnCode of Practice for Highway Maintenance Management found at http://www.ukroadsliaisongroup.org/roads/code_of_practice.htm rnrn this goes into great detail about the classification of the road and how long the council have to repair from the first instance of report.rnrnhope this helps
