by SCOTSBIKER 03 Feb 2010 Having caused over £100 worth of damage to my vans exhaust after hitting a deep pothole near my home in South Manchester, I immediately reported it to my council highways dept.My initial reason for reporting it,was,as i,m also a regular motorcyclist, my concern was that if a biker or cyclist had hit the pothole,the consequences could have been fatal. I then submitted a claim form to them for the damages, and despite the guy on the phone openly admitting the pothole existed, and as he himself used the same road to and from work, he actually said it got worse as the week went on !! My claim was rejected,as they said they were aware of the pothole..so tough luck !! It was over a week before the pothole was repaired ( by that I mean some tar was poured into the hole !) I am looking to take this further..any advice from anyone who has done so ?? It just doesnt seem legal that they can wash thier hands of something we pay through the nose for in taxes. |

My advice is to request the information detailed in the 'how to claim' section of this website via a freedom of information act request. This will detail if they have adopted the highway code and if so what category the road is and how promptly they should repair the pothole after the initial report. It will also detail the number of inspections and any issues with the road. If the information proves that they have not maintained the road in accordance with maintenance high way code they have adopted then you have a case. Good luck.
