Hi im writing this in the hope that someone can help me as injury lawyers and local mp's have failed to do so! Briefly on the 2nd aug last year I tripped whilst walking in the street i live into a pothole approx 5" deep and filled with water so unable to see it. I called for help from my brother who lives nearby and he helped me into the house and then took me home. I went the the hospital the following day as my ankle had swollen to approx 3 times its normal size, i was then sent into Cardiff to the University Hospital of Wales where they diagnosed i had snapped my achilles tendon. I had over the following few months two vain attempts to repair it without surgery and finally had major reconstructive surgery in early December after months on crutches and in casts. I then spent another couple of months first in a plaster cast then a aircast and am now still undergoing physiotherapy and have very limited movement and constant pain and swelling. I applied to one of the no win no fee claims firms advertised online who have basically had me doing their work for them,taking pictures of the hole of my injuries at various stages and contacting witnesses. The Gentleman who lives directly adjacent to the scene witnessed it and has provided a statement to say so. The Council are stating that the hole was marked out with yellow paint only the day before but the witness and my brother who lives 50 metres away are insistent it was marked out at least a week possibly longer than that prior to my accident. In any case that as far as im concerned is irrelivant as the hole was there and i did fall into it and subseqeuntly spent 6 months on statuatory sick pay of only £300 a month! Im not being greedy and you hear of people getting 1000's for whiplash etc, I just want to be reimburshed for the financial and physical hardship i have and am still suffering as a result of this! I have numerous photographs of the hole and evidence it was not repaired for at least 3 weeks after my accident,. I also have a witness statement saying the hole was not marked the day before but quite some time before that. My brother will also confirm that and both have said they are willing to go to court. I have a scar running from my inner foot to just below my knee from the surgery and as i stated constant pain and swelling. If there is anyone who can help or advise me i would really appreciate your input. thank you for taking the time to read my story.
