pothole damaged on private road

i damaged my tyre whilst driving to the cinema with my kids . The hole was covered with water thats why it was not visible, the tyre burst and caused me to skid which frightened the children. I later saw that the tyre burst and black smoke was comming out of it. I wrote to the council who replied and said that they did not own the road as it was privately owned.My next step is going to claim from the road owner as i paid £178 for a new tyre including fotting.
