Solicitor dropped my case, what can I do now.

by June

12 Apr 2010

Last November I took a terrible fall down a pothole in the road that was flooded due to rain, blocked drains, lighting was poor due to streetlamps being broken. I damaged my ankle ligaments and fractured a bone which put me in plaster and on crutches for 3 months. I am a carer for my sister who needs 24hr assistance and suffers many health problems and brain injury. Having no other family I was distraught about how we would manage and in my anger contacted a no win no fee lawyer who said I had a good case. Im on income support and needed taxis to get us around hoping the costs would be recovered. Now the solicitor has written to inform me that a s the local authority has denied responsibility she has closed the files. I am not an advocate of the no win no fee compensation culture, but the council have been inaccurate in their files of which the solicitor has given me a copy not least the pothole ( outside a sheltered housing complex) being crossed by pedestrians as a main route into town, which in my opinion needs a more regular inspection than the 48 weeks the council deems necessary. . This is not just a personal vendetta I am really scared that an elderley person can suffer a similar fate and sustain worse injuries.

Pothole location
37 Prince's St, Nuneaton, Warwickshire CV11 5, UK
Status

I am not an advocate either of the claim society we seem to be being dragged into. Unfortunately our local councils are not looking after and maintaining the basics.rnrnIf I were you I would write letters to your MP, your council, the highways agency and keep on until they listen to what you have to say.rnrnHealth and safety on council roads and pavements should be a priority. rnNot something to check on, ooooh, let's say about once a year!rnGood luck
