Any successful claims???

I have a BMW 750i 12 Alpina sport M

I hit a pot hole measuring 3' x 2' x 8" deep!!!

It broke 2 of my low profile alloy wheels, damaged 2 tyres and my rear spoiler.

I called the council who filled the hole that night, at least 2 other cars were damaged in the same hour!! The pot hole has been refilled twice since due the councils innability to do anything properly!

I filled in a claim form and waited the usual month, having waited a month for the form.

I then had the bog standard fob off reply which all councils will be giving because they do not want to open the flood gates to thousands of claims.

This was from the senior liability administrator. Well you are never going to get an admission of liability from her are you???

So 2 months to tell me after the work of getting quotes to make my claim in the first place that they will not consider my claim as the pot holes are due to a freak of nature and unforseeable weather conditions.

So this means that the people on the council are not even aware that in winter we get minus degree temperatures.

I know where the incoming government should weald the axe when it comes to cutting back on overpaid civil servants.

Anyone who thinks they can claim has got a miniscule chance of success!!

Show me one case on here of a successful claim by anyone over this winters pot holes??

I think I may actually win mine due to some exceptional circumstances

The pot holes have been there since well before the winter and have had several repair attempts.

The pot hole I hit is in an area where the water from farm land close by constantly runs through the bit of road and the pot hole causing constant erosion of that patch of road.

The council have put in a drain just past where the pot hole is (did this 2 years ago) but there are no drains either side for a couple of miles, just the one drain where my pot hole is.

My damage comes to £1900 and I am going to go all the way and sue the Bast***ds!!!

No luck this week and it goes to my solicitors

Wish me luck and I will keep you posted, I will also look to put up all letters and correspondence on the net for info.

This council just wasted approx £2 million on making the inside of Cuilfail tunnel look nice!!!! Ibesciles is a good word!

Take a look at the step-by-step guide under the how to claim section for details of the best way to go about claiming. There are a few success stories under the relevant heading in the read stories section but as you said claiming compensation is a very difficuling to do and it sometimes does just need a little luck and a lot of perseverance! Councils reject around 85% of claims so there are success stories out there just keep your head up! Best of luck!
