Lane adopted by council in bad way

I and my family use a lane that is adopted by the council which is in a bad state of repair and needs to be resurfaced a couple of years ago my father fell on this lane and broke his ankle we did not now at the time that the lane was council owned and to claim off them having no photos of my fathers injuries only photos of the lane and its bad state of repair the lane remains the same unatended I have had my local councillor out to have a look at this and he had a highway maintainance man out and the local councillor said that it was on the list to be done but that was 1year ago and still nothings been done when i phoned to asked the councillor again he replied that the council did not have the money to repair the lane.
