Thank you for your excellent advice. I have successfully claimed against Surrey CC for the cost of a new wheel and tyre on my Jaguar (total claim £765) damaged after hitting a particularly deep and wide pothole. I took your advice to use the Freedom of Information Act to find out both the County's policy on inspecting their roads and the date of the most recent check. Once it became clear that they had not followed policy (ie have 6 monthly inspections), it was relatively plain sailing to make a successful claim. They were a little unfortunate in that it only took 3 months after the next inspection date to make the temporary and then permanent repair, the relatively short delay resulting from the large number of problems caused by the very bad weather last winter. However, they paid up in full, although they had to be reinded to look at the claim. |
