M20 January 2010 - Did anyone else Hit it?

I hit an 8by3 Ft Pot Hole on the M20 Between Jct 8-7 London
Bound (Middle Lane) on 12th January 2010.
9 Months Later No Joy!

I was 1 of approx 30 Cars that hit the Pothole that day and they had to Shut 2x Lanes on the M20 for 2 days to fix it.

Caused £3000 pounds worth of damage to my car.
Airbags Blown, Replaced Wheel/Tyre, suspension, Onboard Computer.

Claiming against the Higways Agency.

They Say 'No Liability' as they inspected the M20 on the 5th January and no defect were found.
My Response is that a 8Ft pot hole doesnt appear Over the space of a Few days and its down to there Negligence it wasnt spotted.

Strangely the Highways Wont provide a copy of the report that says they didnt find any defects that day.

Insurer have put the Claim down as 'My Fault' as they are unable to claim any cost back.

Question - Can the Highways Agency with hold there schedule road reports?

Is there anyone else that hit this Pothole?
I would like to try and find as many people as possible to try and take my claim further?
